“As a property tax consultant located here in Southern California, our firm had a very specific issue arise that involved irrevocable trusts and the Parent-Child Exclusion. The problem we were facing was that one of the beneficiaries wanted the single-asset real property, while the other beneficiaries wanted to be bought ought by the person receiving the real property.Most, if not all, conventional third-party lenders wouldn’t loan to the trustee of the irrevocable trust. These lenders required that the property first be distributed out of the trust, and then take the other beneficiaries off title in order to complete the loan. However, this resulted in an unintended consequence. Taking the beneficiaries off title triggered a substantial reassessment of the property, thereby increasing the property taxes significantly. So, our firm was precluded from assisting these clients and their attorneys in qualifying for the Parent-Child Exclusion. Accordingly, we had to turn away business.
